So Blake is actually correct. In Texas, you can record a phone conversation and you can video people in a public space if the camera if visible, but that's because the courts interpret that as inherent to the situation. If you're talking to someone on a device that could be recorded, then the court views it as reasonable that you could be recorded. If you can see a visible camera, the court views it as reasonable that you could be on video. However, if you put cameras up in a public venue and want to also record sound you have to put a sign up warning people that the audio is being recorded.

So a guy in a stall taking a shit talking about the draft...he has a reasonable expectation to privacy and thus recording him would likely be considered illegal.

Jake, the reason you don’t see a lot of older people with Down syndrome is due to the ones that make it that long often outlive their parents and are put in to care facilities where they don’t get out in public compared to when their parents were alive to get them out and about.
